Laffey, Bucci & Kent Lawyer Secures $350,000 in Philadelphia Sidewalk Accident Case

Last week, firm partner Brian Kent settled a fall accident case in Philadelphia for $350,000. The accident occurred at a drugstore/pharmacy in Chester Springs, PA, which is located north of Exton, roughly 30 miles outside of Philadelphia.

The plaintiff tripped and fell on the sidewalk in front of the drugstore and suffered major injuries including a fractured hip which required surgery. As a result, the plaintiff incurred thousands of dollars in medical bills, and also lost some time from work.

Even though the accident occurred in Chester County, the case was filed in Philadelphia, due to the fact that the defendant drugstore operated in and around the County of Philadelphia.

The plaintiff was very pleased with his representation by Mr. Kent:

“I was very pleased with the way my case was handled at your law firm.  Brian Kent was very helpful representing us.  I would highly recommend your office to others.  Everyone in the office is a true professional.  Thank you for all of your help.” -SB

Store Sidewalk Accidents

Store sidewalk accidents are very common and often occur due to a store’s failure to take proper care of the concrete and surrounding areas, such as the curb and parking lot pavement. Sidewalk accidents often occur due to:

  • broken/missing pieces of concrete,
  • invasion of tree roots causing uneven areas,
  • sloping defects, and
  • threshold variations.

Defendants in Store Sidewalk Accidents in Pennsylvania

In Pennsylvania, commercial businesses owe a very specific duty to customers, and that is the duty to take reasonable care of the property and surrounding premises to prevent unreasonably dangerous conditions from developing. That duty encompasses an additional requirement, i.e., conducting reasonable, periodic inspections to look for such conditions.

The duty applies to all types of stores, including:

  • grocery stores,
  • drugstores/pharmacies,
  • restaurants,
  • shopping malls,
  • department stores, and
  • smaller retail stores.
