Laffey, Bucci & Kent founding partners, Paul Bucci and Brian Kent, were featured in the New Jersey Law Journal for their recent settlement of a major marine terminal accident case.

In the case, Tomasulo v. New York Shipping Association, Inc., the plaintiff was run over by a forklift, caught underneath and dragged for several feet.  Mr. Tomasulo suffered significant, career-ending injuries.

The incident occurred at the Cape Liberty Cruise Ship Terminal in Bayonne, New Jersey.  Bucci and Kent were able to establish that the main defendant in the case, New York Shipping Association, Inc.’s forklift training policies and procedures for marine terminal forklift operators violated OSHA requirements for forklift training.

In addition to a $2.75 million settlement with New York Shipping, there were three additional, confidential settlements with co-defendants.
