Philadelphia Doctor Arrested for Sex Assault of 2 Patients During Routine Exams

Philly area doctor Brij Srivastava faces 2 charges of sex assault of 2 patients. Indecent Assault charges were filed in November after a victim alleged the doctor fondled her during an exam. Additional victims are being sought by the Upper Darby, PA Police Department.

A Pennsylvania area doctor faces criminal charges of indecent assault involving two patients at a medical center in Upper Darby, just outside of Philadelphia. One of the victims fled during a routine physical exam where the doctor is alleged to have fondled her breasts. The criminal investigation began when the same victim filed a report with local law enforcement.

The arraignment was held on November 14, 2017 after the doctor turned himself in to the Upper Darby Police Department on two charges of Indecent Assault Without Consent, a second degree misdemeanor. The doctor was charged with violation of Section 3126(a)(1) of the PA Crimes Code which provides:

(a)  Offense defined.–A person is guilty of indecent assault if the person has indecent contact with the complainant, causes the complainant to have indecent contact with the person or intentionally causes the complainant to come into contact with seminal fluid, urine or feces for the purpose of arousing sexual desire in the person or the complainant and:

(1)  the person does so without the complainant’s consent.

The doctor has posted bail and was released. Now, a Delaware County judge will decide whether the case can proceed at the Preliminary Hearing which is scheduled for December 1, 2017. If the court finds that the evidence is sufficient to go forward, the case will be transferred to the Court of Common Pleas, criminal docket.
