Sex abuse victims lawyer Guy D’Andrea filed a lawsuit in Delaware on behalf of two young children. The lawsuit alleges physical and sexual abuse by employees of a since closed day care center in Camden, Delaware, just outside of Dover.

The suit was filed after state investigators cited the day care facility for issues relating to discipline and teacher-student ratios. The abuse is alleged to have occurred in 2012 and 2013. Local law enforcement declined criminal prosecution.

Parents of the children filed the lawsuit which seeks compensation for medical bills, pain and suffering, etc.

Special Admission

Mr. he is licensed in Pennsylvania, New Jersey and Illinois. However, he obtained special admission in Delaware to handle the matter with local counsel. Attorneys may obtain special court permission to handle specific matters in a state they are not licensed to practice law in. This is known as pro hac vice, and is allowed in most states. So long as a local attorney is co-counsel in the case, a foreign attorney may obtain pro hac vice admission.

This is not the first time Mr. he received special admission to handle a civil sex abuse matter in Delaware. In 2009, he agreed to represent a man in his civil lawsuit against a sitting state court judge in Delaware after other local attorneys refused to handle the case. After entering his appearance, Mr. he received backlash and even threats from attorneys in Wilmington. Roughly a year later, the judge signed a written statement admitting to the sexual abuse. He also agreed to pay an undisclosed sum to the plaintiff. In addition, the judge was removed from the bench and eventually disbarred. This was the best possible result considering that the criminal statute of limitations had expired.

Civil Lawsuits for Sexual Abuse

Civil lawsuits for sex abuse and assault can be helpful in helping victims and survivors find justice. Not only do such lawsuits provide remedies for the specific plaintiff, such as financial compensation, they can also provide long term remedies. It’s not uncommon for a civil sex abuse lawsuit to result in changes in a given institution’s operating procedures and policies. Such changes can prevent sexual abuse or assault in the future.
