Anyone who owns, manages, or somehow controls or occupies property is held financially responsible under state and federal law for any accidents that happen on that property resulting in injuries.
The Law Provides for Accidents and Injuries That Happen on Someone's Property
These laws are broadly written, because they cover a lot of different situations. For example, the injuries from a slip and fall on an icy restaurant walkway will be covered by the same law as an injury to a child who was hurt while playing at a fast-food restaurant's playground and the same law will also provide for a woman who was mugged as she exited a department store. Defective conditions, inadequate maintenance, and inadequate security can all result in premises liability.
Money Damages Available to Premises Liability Injury Victims
It is well established under the law that someone injured on the property of another is justly entitled to receive past and future medical expenses, pain and suffering, lost wages, and the like. Those responsible for the injury, due to dangerous property conditions that caused the accident, will have to compensate the victim and his/her family for some or all of these types of damages.
Not Every Injury Victim Is Treated the Same under Premises Liability Law
The law, however, does distinguish between the different types of people who come onto another's property. There is less of an obligation under the law to pay for the injuries suffered by a criminal trespasser than for the injuries sustained by someone invited to the property (e.g., a guest or a customer).
Defendants, therefore, will spend a significant amount of time trying to label the injury victim as someone less than an "invitee" in order to keep their damage totals low - in addition to criticizing the extent of their injuries, and questioning whether or not there are other circumstances (such as preexisting medical conditions) that have contributed to the victim's harm. All too often, premises liability victims are disrespected and considered greedy or dishonest by defendants and their counsel.
